Please read these terms carefully before scheduling a consultation or using our platform. These rules define the agreement between you and Kappiness regarding our psychological care services.
1. Acceptance of Terms
By accessing, browsing, or using the Kappiness Online Consultation platform (the "Website," accessible at onlineconsultation.kappiness.in) or scheduling a psychological consultation session, you acknowledge that you have read, understood, and agree to be legally bound by these Terms & Conditions.
These terms constitute a binding legal agreement between you ("User," "Client," or "you") and Kappiness. If you do not agree with any portion of these terms, please discontinue your access to the Website and do not book any consultations.
2. Online Consultation Policy
Kappiness provides professional psychological counseling, therapy support, and online consultations. These consultations are conducted remotely using digital audio/video telecommunication tools.
- Service Nature: Online counseling relies on a collaborative relationship between you and a licensed, professional psychologist. While counseling has been proven highly effective in helping individuals work through anxiety, depression, and relationship stress, outcomes are not clinically guaranteed and depend on active individual participation.
- Technical Requirements: You are responsible for ensuring that you have a private space, a compatible device equipped with a functioning camera and microphone, and a stable, high-speed internet connection to conduct your sessions. Kappiness is not responsible for session disruptions caused by poor internet quality on your end.
- Scope of Practice: Online consultations are not a substitute for in-person psychiatric medical evaluation in cases of acute, severe psychiatric disorders requiring physical clinical intervention or prescription medication. Our psychologists do not prescribe medications.
3. Appointment Booking
To schedule a consultation, you must use our embedded scheduling application. You agree to:
- Provide current, accurate, and complete contact details (name, phone number, email address).
- Select a date and time slot that you can commit to attending.
- Pay the specified consultation fee in advance to secure the appointment. Bookings are only finalized upon receipt of payment confirmation.
4. Cancellation Policy
We value both our clients' and our psychologists' time. Our scheduling system is optimized to allocate therapy hours effectively. Therefore, the following cancellation policy applies:
- Advance Notice: You must request a cancellation at least 24 hours before the scheduled session start time.
- Late Cancellations: If you cancel a session less than 24 hours prior to the appointment, or fail to join the session within 15 minutes of the start time (no-show), you will be charged the full amount for the session, and no refund will be issued.
5. Rescheduling Policy
If you need to change your appointment date or time, we require significant advance notice to assign that slot to other clients:
- Rescheduling Window: You may reschedule an appointment up to 24 hours before your scheduled session.
- How to Reschedule: Rescheduling can be initiated through the link in your confirmation email or by contacting our support team directly via WhatsApp or email.
- Exceptions: Rescheduling requests made less than 24 hours prior to the session start time will be treated as late cancellations, and the session fee will be forfeited.
6. Refund Policy
Refunds are processed selectively in accordance with the following terms:
- Valid Refunds: If you cancel your session with more than 24 hours of advance notice, you are eligible for a full refund of the consultation fee, minus any transaction charges applied by our payment gateway.
- Therapist Unavailability: In the rare event that our psychologist is unable to attend the session due to an emergency and we are unable to offer you an alternative therapist, you will receive a 100% refund.
- Processing Time: Approved refunds will be credited back to your original source of payment within 5 to 7 business days from the date of cancellation approval.
- Completed Sessions: No refunds are issued for consultations that have already occurred, in whole or in part.
7. User Responsibilities
As a user of our platform and a clinical client, you agree to:
- Provide truthful, accurate, and up-to-date details regarding your identity, age, and basic mental health history.
- Treat all psychologists and support staff with respect and professional courtesy. Abusive, harassing, or sexually suggestive language will result in the immediate termination of the session and a permanent ban from our services without a refund.
- No Recording: You are strictly prohibited from recording, videotaping, capturing audio, or publishing any parts of your counseling sessions. Recording clinical consultations violates the psychologist's intellectual property, patient confidentiality standards, and clinical privacy guidelines.
- Age Eligibility: You must be at least 18 years of age to book a consultation independently. If you are under 18, you must have your parent or legal guardian schedule the appointment on your behalf.
8. Confidentiality
The client-counselor relationship is confidential. Our psychologists are ethically and legally bound to keep details shared during therapy sessions strictly private.
Limits of Confidentiality: You acknowledge that confidentiality may be breached under specific circumstances:
- Where we determine that you pose an immediate, severe threat of harm to yourself (suicidal behavior) or to others.
- Where we are legally compelled to release records or information by a court order or legal mandate.
- In cases involving the abuse, neglect, or exploitation of a child, elderly person, or vulnerable adult.
9. Emergency Disclaimer
KAPPINESS IS NOT A CRISIS HOTLINE
If you are experiencing a psychiatric emergency, severe panic attacks, thoughts of suicide, self-harm, or violence, please do not wait for an online appointment.
Our platform is for scheduled consultations and does not provide immediate, emergency crisis intervention. Please immediately contact local emergency services in India by dialing 112 or 100, or call a dedicated helpline such as KIRAN (1800-599-0019) or AASRA (91-9820466726).
By accepting these terms, you understand that our website, scheduling application, and support lines are not configured for immediate medical or psychological emergencies.
10. Intellectual Property
The Website, including its structural layout, designs, text content, logos, illustrations, custom icons, graphics, and code is the exclusive intellectual property of Kappiness.
You are granted a limited, personal, non-transferable, and revocable license to access the Website for informational purposes and booking scheduling. You may not copy, scrape, distribute, reproduce, modify, republish, or commercialize any content from our Website without our express, prior written consent.
11. Website Usage
You agree to use our Website only for lawful purposes. You are strictly prohibited from:
- Using our forms or calendars to send spam, unsolicited promotional material, or malicious scripts.
- Attempting to breach, bypass, or compromise the website's security controls, SSL encryption, or user databases.
- Using automated crawlers, scrapers, or bots to harvest data or bookings from our systems.
- Impersonating any other individual, clinic, or business entity when communicating or booking sessions on our platform.
12. Limitation of Liability
Kappiness, its founders, clinical psychologists, employees, and developers shall not be liable for:
- Any direct, indirect, incidental, special, or consequential damages resulting from your use of or inability to use our Website or consultation services.
- Any technical issues, server crashes, power failures, or video communication interruptions that are beyond our reasonable control.
- Decisions made or actions taken by you during or after your counseling sessions. You take full responsibility for your personal progress, clinical outcomes, and choice to implement recommendations shared by our therapists.
13. Governing Law (India)
These Terms & Conditions, and any disputes, differences, or legal proceedings arising out of or related to our platform, shall be governed by and construed in accordance with the laws of India.
You agree that any legal action, suit, or proceeding arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the competent courts of Kochi, Kerala, India.
